Notice of Confirmation of an Order (Other than an Acquisition Extinguishment Order)

Highways Act 1980 - Section 119

Essex County Council Footpath 23 (Part), Great Maplestead In the District of Braintree Public Path Diversion Order 2011

On 2 December 2011 Essex County Council confirmed the above Order made under section 119 of the Highways Act 1980.
The effect of the Order will be to divert a part length of public Footpath 23 in the Parish of Great Maplestead commencing from Hovis Mill Lane to an alternative route being 2 metres in width from a point slightly north at Hovis Mill Lane in a generally north easterly then south easterly direction to the same point where it meets the unaffected part of Footpath 23.

A copy of the Order and the Order Map have been placed in and may be seen free of charge at Braintree District Council Offices at Causeway House, Bocking End, Braintree CM7 9HB and at the Chelmsford Public Library, Market Road, Chelmsford during normal working hours. Copies are available on request from the Chelmsford Library at a charge

The alternative route comes into force on 30 December 2011 when the old route shall be stopped up, but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 16 December 2011 make an application to the High Court.
